Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Stimy AI mobile application and related services (the "App"), provided by BrainByte, Inc. ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Eligibility and Children

The App is intended for students and learners of math. Users under the age of 13 may use the App only with the involvement and consent of a parent or guardian, and in accordance with our Privacy Policy and applicable law, including COPPA.

License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial educational purposes. You may not copy, modify, distribute, sell, or lease any part of the App, or reverse engineer or attempt to extract its source code, except where permitted by law.

Accounts

To use certain features you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

Subscriptions and Payments

• Stimy AI+: Some features require a paid subscription ("Stimy AI+"). Pricing and available plans are shown in the App before purchase.
• Billing: Subscriptions are billed through your Apple App Store or Google Play account and are subject to those stores' terms.
• Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store or Google Play account settings.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Charges begin at the end of the trial unless cancelled beforehand.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Upload content that infringes the rights of others or is unlawful, harmful, or offensive;
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
• Use the App to cheat in a manner that violates the rules or honor code of your school or institution.

Educational Content and AI Accuracy

Stimy AI uses automated and AI-based methods to recognize and solve math problems. While we strive for accuracy, the App may produce incomplete or incorrect results. The App is provided as a learning aid and should not be relied upon as a substitute for professional instruction or independent verification. You are responsible for how you use any output.

Intellectual Property

The App, including its content, design, and software, is owned by BrainByte, Inc. and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Third-Party Services and Advertising

The App may include third-party services, links, or advertising. We are not responsible for the content, policies, or practices of any third parties, and your use of such services may be subject to their own terms.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, BrainByte, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App.

Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or if we discontinue the App. You may stop using the App at any time.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

Changes to These Terms

We may update these Terms from time to time. We will notify users of any material changes by posting the updated Terms on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
